SFO applies for its second Deferred Prosecution Agreement

At a public hearing tomorrow, 8 July 2016, the Serious Fraud Office will apply for final approval of a Deferred Prosecution Agreement with a UK SME which cannot currently be named due to ongoing legal proceedings. The application will be made before Lord Justice Leveson, President of the Queen’s Bench Division, at Southwark Crown Court, sitting at the Royal Courts of Justice Court 4 at 10:30 am. Lord Justice Leveson has already approved the DPA in principle.
At the conclusion of the hearing, the SFO will publish a redacted judgment on its website. The unredacted judgment, statement of facts and terms of the DPA will be published in full when the related legal proceedings are concluded.
We expect a court order governing the reporting of the judgment to be put in place at tomorrow’s hearing. The strict liability rule in the Contempt of Court Act 1981 applies.
